法的明確性の原則は、刑事的責任が法律の明確かつ正確な規定により限定されなければならないことを求め、もって何が法律で禁止される行為なのかについて合理的に認識できるようにし、不必要に禁止される行為の範囲が広がらないようにしています。現在の「共謀罪法案」は、抽象的かつ主観的な概念が極めて広く解釈され、法的な不透明性をもたらすことから、この原則に適合しているようには見えません。
The principle of legal certainty requires that criminal liability shall be limited to clear and precise provisions in the law, ensuring reasonable notice of what actions the law covers, without unduly broadening the scope of the proscribed conducts. The "anti-conspiracy bill" in its current form does not appear to conform to this principle given that is vague and subjective concepts could be interpreted very broadly and lead to legal uncertainty.
